Lead agency review team to issue corrective actions beginning Jan. 1, 2020, for non-compliance with support-plan timelines

Effective Jan. 1, 2020, the home and community-based services (HCBS) lead agency review team (LAR) will begin to issue corrective actions to lead agencies when the required timeline for support plans is not followed.

(Support plans document the services and supports a person has agreed to receive, as well as details about who will provide the services and how often.)

Timeline requirements

To be compliant, the lead agency must send a copy of the person’s Coordinated Services and Support Plan (CSSP) or Collaborative Care Plan to the person (or the person’s guardian/legal representative, when applicable) within 60 calendar days of the assessment.

LAR process

The LAR team reviews case files for evidence of compliance with this 60-day timeframe. If the lead agency does not meet the timelines, it must respond to DHS and develop a corrective action plan that outlines how it will bring its practices into compliance.

Background

The lead agency review process is a collaborative, evaluation process that examines all five Medicaid waiver programs and the Alternative Care Program in each lead agency (counties and tribal nations) across the state. The LAR team conducts multi-day, onsite visits at each lead agency that include:

  • · Focus group sessions with lead agency case managers and assessors
  • · Interviews and meetings with agency leadership
  • · A review of the lead agency’s case files.
  • Currently, the team is on Round 4 of the statewide review. During Round 3, the team did not issue corrective actions for the support-plan timeline requirement, as the LAR team was continuing to refine protocols and validate data collection.
