Advocates for reform have applauded the move as a step in the right direction—though it does nothing to federally legalize cannabis. Prohibition advocates may file lawsuits if and when rescheduling rules are formally proposed. Assuming cannabis is successfully rescheduled, it will alleviate several legal burdens that have hindered the success of state-legal cannabis programs. “Litigation Finance: Impact to the Semiconductor Space” – An all-new Semi Interesting Podcast is here! Cost can be a limiting factor (or even THE limiting factor) when considering a patent infringement lawsuit. Staying under a million dollars in legal spending can be considered a victory of sorts for complex matters. That is a huge impediment to small companies and entrepreneurs. On this episode, we explore an alternative that may help level the playing field across high-tech industries: litigation funding. Nathaniel Lucek and Elizabeth Morris are joined by Justin Maleson from Longford Capital to discuss how litigation funding works and what makes an interesting case for a litigation funder. Copyright plaintiffs prevailed as the Supreme Court definitively expanded the scope of monetary damages available in discovery-rule copyright infringement cases. The discovery rule of accrual provides that a copyright claim accrues when the plaintiff discovers (or reasonably should have discovered) the infringement, regardless of when the infringing conduct occurred. Under the discovery rule of accrual, it is possible for a copyright holder to make claims about potentially very old infringements. But what was not clear was the ability for the damages to go back in time for those past acts of infringement.
